Party Terms and Conditions

TERMS AND CONDITIONS

THANK YOU FOR CHOOSING SUGAR PLUM PARTIES!

These terms and conditions are between you and DJ KMD LLC dba Sugar Plum Parties and relate to the event specified on your application/reservation form. You should review all of the terms and conditions because together they create an agreement upon which we will rely in creating and producing the event.

BY CHECKING THE BOX ON THE RESERVATION FORM, YOU AGREE TO ACCEPT THESE TERMS AND CONDITIONS

1. RESERVATIONS. We require a $100 ( $200 for Magical Soiree) non refundable deposit in order to secure your event date and time. Until your deposit has been received, you are not guaranteed the date or time requested, even if the item has been added to your cart. Your deposit will be applied to the cost of your event, but will not be refunded under any circumstances. For payment options, we accept all major credit cards online.

2. PAYMENTS. We require payment in full for the event prior to the start of the event. For your convenience, we accept all major credit cards as well as cash. Sorry we do not accept checks. While it is not required or included in your Party Package, gratuities are welcomed at your discretion. Your party hosts will indeed do a great job and we look forward to celebrating with you!

3. RESCHEDULING AN EVENT; CANCELLATIONS. If you need to reschedule your event, we will apply your deposit to the rescheduled event if you have notified us of the change more than 30 days prior to the originally scheduled event date. If you are not able to notify us more than 30 days prior to the originally scheduled event date, your deposit will not be applied to the rescheduled event. If you cancel your event at any time and do not reschedule at the time of cancellation, your deposit will be not be refunded.

4. LIABILITY WAIVERS. All event guests must complete and sign our liability waiver online, prior to the event. A parent or guardian must sign on behalf of any guest under the age of 18. We will be unable to allow anyone who has not furnished us with a completed and signed liability waiver to attend the event. THERE ARE NO EXCEPTIONS TO THIS RULE.

5. EVENTS.

(a) The cost of your event covers the number of guests stated in the party package; not including the host parent(s)/guardian(s) and any parents/guardians who would like to stay. Adults are welcome to stay at no additional charge. However, food and activities will not be provided for adult guests unless you have arranged for it in advance. We charge $69.99 per additional guest included in the final headcount (even if a guest does not attend). Events are intended for children aged 3-13. While we do not have a stated maximum number of guests or age limits, and we will do our best to accommodate your needs, please contact us if you anticipate additional guests or guests younger than 3 or older than 13 so that we can plan accordingly. We reserve the right to limit the total number of guests or to not accept guests younger than 3 or older than 13. A FINAL HEADCOUNT IS REQUIRED NO LATER THAN THREE BUSINESS DAYS PRIOR TO YOUR EVENT.

(b) Host parent(s)/guardian(s) must stay for the entire event. We will do our best to accommodate parents and siblings who wish to stay for the event; but again, we reserve the right to limit the total number of guests.

(c) While our venue is completely private and we cater to one event at a time; please note that party start and end times may slightly overlap with the party before or after yours while guests are leaving and arriving. Events are scheduled for 1.5 to 3 hours, depending on the number of guests.

(d) We provide clothing, costumes and props for each event. All clothing and costumes are washed after each use. Guests should wear appropriate undergarments (underwear, leotards, bodysuits, etc.). We reserve the right to charge you an additional amount for any items supplied by us that are damaged during the event or removed from the event.

(e) No outside food, decorations or props are permitted at your event unless specifically approved in advance. No illegal substances are allowed on our premises.

(f) We host several events daily; therefore, guests will be admitted only at the scheduled start time for the event. However, we encourage you to drop off any party favors, cake or other items (that have been approved) a few minutes prior to the scheduled start time for the event.

(g) Any guest arriving late will be permitted to join the event in progress. However, an event will not be extended beyond its scheduled end time due to late arrivals (even if the host parent(s)/guardian(s) are late).

(h) While we will do our best to manage any behavioral issues, ultimately it is the responsibility of the host parent(s)/guardian(s) to manage/resolve any misbehavior of any guest directed toward any other guest or our event coordinators, and to manage/resolve any behavioral issues of guests that otherwise disrupt the event.

6. INDEMNIFICATION. You agree to indemnify and hold us, our members, managers, directors, officers, employees, representatives and agents harmless from and against any damage, harm, claims or other costs incurred by us, any of our employees or property, or any third party, arising out of or resulting from the acts or omissions of you, any of your guests or any of the parents/guardians of your guests, other than those caused by our own gross negligence or willful misconduct.

7. GENERAL.

(a) These Terms and Conditions and the Liability Waiver constitute the entire agreement between you and us with respect to the subject matter hereof, and supersede all prior or contemporaneous agreements, understandings, proposals and communications, oral or written, regarding such subject matter. You acknowledge and agree by signing below you are representing that you are not relying on any statement, representation, warranty or understanding other than as expressly set out in these Terms and Conditions.

(b) These Terms and Conditions are for the benefit of you and us, and not for any other person.

(c) If any term, condition or provision, or any portion of any term, condition or provision, contained in these Terms and Conditions is determined to be invalid or unenforceable under any statute or rule of law, such provision shall be enforced to the maximum extent possible to give effect thereto, and the remainder of these Terms and Conditions shall remain in full force and effect to the maximum extent permissible without being impaired or invalidated in any way.

(d) No waiver of any of term or condition will be implied by failure to enforce such term or condition and no express waiver will affect any rights or remedies other than that to which the waiver is applicable and only for that occurrence. No term or condition shall be deemed waived, amended or modified by either party, unless such waiver, amendment or modification is in writing and signed by authorized representatives of party against whom enforcement is sought.

(e) These Terms and Conditions shall be governed by and construed in accordance with the laws of Massachusetts without regard to the conflict of laws provisions thereof.

By acknowledging this Agreement, I acknowledge that I have had sufficient opportunity to read this entire Agreement and voluntarily agree to be bound by its terms.
